Summary

  • When you create an account with us, you provide personal details such as your first name, last name, email address, and company name. We securely store this information and use it to enhance our services for you. Access to this data is restricted to Digitonica SRL employees, contractors, and subcontractors, and it is never disclosed for commercial benefit to unauthorized individuals or entities.
  • When your QR codes are scanned, we collect scan information (such as approximate location and device type) on your behalf and show it to you as analytics. Beyond providing your analytics, we use this data only in aggregated, anonymized form — never in a way that identifies you, your visitors, or your business.
  • This summary is provided for convenience. The full terms below are what govern your use of QRKIT.

Who We Are

These Terms of Service form a binding agreement between you and Digitonica SRL, a company registered in Romania (Trade Register No. J18/1195/2022, fiscal code CUI 46142569), with its registered office in Craiova, Dolj, Romania ("QRKIT", "we", "us"). By creating an account or using the service, you accept these terms. You can reach us at [email protected].

The Service

QRKIT lets you create, customize, and manage QR codes — including dynamic QR codes whose destination you can change after printing — and view analytics about how they are scanned. Features and limits vary by plan; the current plans and what they include are described on our pricing page. We continuously improve the service and may add, change, or remove features. If a change materially reduces the core functionality of a paid plan, we will notify you in advance.

Your Account

  • You must be at least 16 years old to create an account, and the information you register with must be accurate and kept up to date.
  • You are responsible for keeping your login credentials secure and for all activity that happens under your account.
  • If you use QRKIT on behalf of a company, you confirm that you are authorized to accept these terms for that company, and "you" includes that company.

Acceptable Use

You may not use QRKIT, or QR codes created with QRKIT, to:

  • link to, host, or distribute content that is illegal, fraudulent, defamatory, or that infringes the intellectual property or privacy rights of others;
  • conduct phishing, distribute malware, or deceive people about where a QR code leads or who operates the destination;
  • send spam or collect personal data from the people who scan your codes in violation of applicable law — you are responsible for your own legal compliance toward your visitors, including any consent or notice the destination content requires;
  • probe, disrupt, or overload the service, attempt to access other users' data, or circumvent plan limits or access controls;
  • resell or white-label the service without our written consent.

We may disable individual QR codes, remove content, or suspend or terminate accounts that violate this section. Where practicable we will notify you and give you a chance to remedy the problem, but we may act immediately when needed to protect the people scanning your codes, other users, or the service itself.

Your Content & QR Codes

  • You keep full ownership of the content you put into your QR codes and your account. You grant us the limited license needed to host, store, process, and display that content solely to provide the service.
  • The QR code images you generate are yours to use for any lawful purpose, including commercially, on any material.
  • You are responsible for the content of your QR codes and their destinations, and you confirm you have the rights needed to use what you upload.
  • The QRKIT platform, software, design, and trademarks remain our property. These terms do not grant you any rights in them beyond the use of the service.

Plans, Billing & Renewal

  • Paid subscriptions are billed in advance through our payment provider, Stripe, on a monthly or annual cycle, and renew automatically until cancelled. You can cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period.
  • If we change a plan's price, we will give you at least 30 days' notice by email before the new price applies to your next renewal. If you don't agree, you can cancel before the renewal.
  • The free plan has usage limits, including a monthly scan limit on dynamic QR codes. When a limit is exceeded, scans of the affected codes may be paused (visitors see a notice page) until the limit resets or you upgrade, and free-plan QR codes may display QRKIT branding. We may adjust free-plan limits over time.
  • If a renewal payment fails and is not resolved, your account is downgraded to the free plan and its limits apply.
  • Prices are exclusive of any applicable taxes unless stated otherwise.

Refund Policy

QRKIT operates under a limited refund policy for subscription payments. We understand that circumstances may change, and we strive to be fair while maintaining the sustainability of our service.

Statutory rights (EU/EEA consumers). Nothing in this policy limits your non-waivable statutory rights. If you are a consumer in the EU/EEA, you have a 14-day right of withdrawal when you purchase a subscription. By purchasing, you request that the service start immediately; if you withdraw within the 14 days, we refund you via the original payment method without deducting processing fees, retaining only a proportionate amount for the service already provided where the law permits. The right of withdrawal lapses once the service has been fully performed.

General Policy

  • All refund requests are reviewed on a case-by-case basis and are subject to approval at QRKIT's discretion.
  • Refunds may be considered for unused portions of annual subscriptions when requested within 30 days of the original purchase date.
  • Monthly subscriptions are generally non-refundable due to their short-term nature and immediate service access.
  • No refunds will be provided for accounts that have violated our Terms of Service or have been suspended for misuse.

Refund Process

  • To request a refund, please contact our support team with your account details and reason for the refund request.
  • Approved refunds will be processed through the original payment method within 5-10 business days.
  • Refund amounts may be subject to processing fees charged by payment processors, which will be deducted from the refund amount.
  • During the refund processing period, your account may be downgraded to the free plan, and premium features will be disabled.

Dispute Resolution

  • In cases where refund requests are initiated through your payment provider (credit card company, Stripe, etc.), your account access may be suspended pending resolution.
  • If a chargeback or dispute is filed without first contacting QRKIT support, we reserve the right to permanently suspend the account.
  • Upon successful dispute resolution in the customer's favor, the subscription will be cancelled and account access will revert to the free plan.

By subscribing to QRKIT services, you acknowledge that you have read and agree to this refund policy. This policy may be updated from time to time, and continued use of our services constitutes acceptance of any changes.

Termination

  • You can delete your account at any time from your account settings. Your data is then erased as described in our Privacy Policy.
  • We may suspend or terminate your account for material breach of these terms, illegal use, unresolved non-payment, or where the law requires it. Where practicable, we will notify you first.
  • When an account is closed, its dynamic QR codes stop redirecting. Keep this in mind if your codes are printed on physical materials.

Disclaimers

The service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted or error-free, and scanning also depends on devices, cameras, and software we do not control. We are not responsible for the destination content of QR codes created by our users. If you are a consumer, this section does not affect any statutory warranty rights you have under applicable law.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, lost profits, lost revenue, or lost data arising from your use of the service, and our total liability for all claims is limited to the greater of the amounts you paid us in the 12 months before the event giving rise to the claim or €50. This does not exclude or limit our liability for intent or gross negligence, for death or personal injury, or for any other liability that cannot be excluded under applicable law, and it does not affect the mandatory rights you have as a consumer.

Changes to These Terms

We may update these terms from time to time. If a change is material, we will give you reasonable advance notice — by email or a prominent notice in the service — before it takes effect. Continued use of the service after the change takes effect constitutes acceptance; if you do not agree, you can cancel your subscription and stop using the service before then.

Privacy & Data Protection

Our processing of personal data — what we collect, the legal bases, how long we keep it, the processors we share it with, and your rights under the GDPR — is described in our Privacy Policy, which forms an integral part of these Terms of Service.

Governing Law

These Terms of Service are governed by the laws of Romania and applicable European Union law. Any dispute arising from or relating to these terms will be submitted to the competent courts of Romania. If you are a consumer in the EU/EEA, this does not affect any mandatory consumer protections of, or your right to bring proceedings in, your country of residence.
